Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Technovaa AI/ML platform ("Service") provided by Technovaa, Inc. ("Technovaa", "we", "us"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.
1. Your account
You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at beckett@technovaa.online if you suspect any unauthorized use.
2. Acceptable use
You agree not to (a) use the Service to violate any law or infringe anyone's rights, (b) attempt to reverse-engineer, decompile, or otherwise extract our source code, (c) use the Service to develop a competing product, (d) generate or distribute content that is defamatory, harassing, or hateful, (e) circumvent rate limits or usage caps, or (f) upload malware or otherwise interfere with the Service's operation.
3. Your content and models
You retain ownership of everything you upload, train, or generate on the Service ("Customer Content"). You grant Technovaa a limited license to host, process, and transmit Customer Content solely to operate the Service on your behalf. We do not train foundation models on your Customer Content.
4. Fees and billing
Paid plans are billed monthly or annually in advance. Usage overages are billed monthly in arrears. All fees are non-refundable except where required by law. You are responsible for all applicable taxes.
5. Free tier
The Starter plan is provided at no cost. We reserve the right to change the Starter tier at any time with 30 days' notice. Excessive or abusive use of the free tier may result in suspension.
6. Service availability
We target 99.99% uptime for the paid Service and publish real-time status at status.technovaa.online. Uptime commitments and service credits are documented in the applicable Service Level Agreement.
7. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms or if we're required to do so by law. You may terminate at any time in Settings → Billing. Upon termination, your data remains read-only for 30 days to allow export before deletion.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNOVAA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Machine learning models produce probabilistic outputs; you are responsible for evaluating their fitness for your use case.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHNOVAA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email at least 30 days before the change takes effect.
